Indictment unsealed in Montana meth conspiracyA man arrested in Arizona pleaded not guilty in Billings, Montana on Tuesday to federal drug-conspiracy charges.
Andrew Daniel Lucero, 40, was charged with four counts in an indictment unsealed with his arraignment. He is the last of three defendants to appear.
The indictment charges Lucero with conspiracy to possess with intent to distribute methamphetamine and marijuana and with possession with intent to distribute meth and marijuana.
The maximum sentence for the meth charges is five years to 40 years in prison and a $2 million fine, while the charges involving marijuana carry a maximum penalty of up to five years in prison and a $250,000 fine.
The indictment alleges that, before and after July and August 1998 in Montana and elsewhere, Lucero conspired and possessed with intent to distribute more than 50 grams of meth and about three pounds of marijuana.
Lucero’s co-defendants are Josephine Espinoza, 46, and Chris Espinoza, age unavailable. Both pleaded not guilty in earlier arraignments.
Josephine Espinoza already is serving a five-year, 11-month federal sentence for convictions of conspiring to bring large quantities of marijuana to Montana in the 1990s and for lying to the government.
Josephine Espinoza and Chris Espinoza also have pleaded not guilty to a separate, five-count indictment alleging that they and others conspired to possess with intent to distribute more than 220 pounds of marijuana in Montana from April until August of 1998.
U.S. Magistrate Richard Anderson ordered Lucero detained until trial or further order of the court. The case will be heard by U.S. District Judge Richard Cebull.
